Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks legal authority.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The situation stems from a erroneous deportation to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to face human smuggling charges, he was held in federal detention.
In her order, the court pointed out that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal challenge center on disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in the state of Tennessee.
